Section 41
Use of Digital Signatures in Government Offices
(1) For the authenticity of any document or record to be transmitted or issued by a government agency or public institution or a bank or financial institution transacting business within the State of Nepal, or to be accepted or received from such agency or institution, the document or record must be signed by the person concerned. If the government of Nepal deems it appropriate, instead of such a signature, it can arrange for a digital signature.
(2) Notwithstanding anything contained elsewhere in this Act, the Government of Nepal may, for the purpose of sub-section (1), prescribe additional safeguards for the authenticity and authenticity of such digital signature.
(3) In relation to the digital signature used by the agency or organization as per sub-section (1), the arrangements regarding the certifying body and the digital signature certificate shall be as prescribed.
